1. Who we are
These Terms are a contract between you and Embodied: Integrative Wellness(the "Seller", "we", "us"), the provider of the Awakening Through Relationshiptoolkit (the "Service"). By creating an account, purchasing, or continuing to use the Service, you agree to these Terms.
2. The Service
The Service is a digital toolkit made up of written material, guided audio recordings, and a private journaling space designed to support personal reflection while dating. It is a self-guided practice — not therapy, medical advice, or a substitute for clinical care.
3. Your account
You must be of legal age in your jurisdiction. Keep your login credentials confidential; you are responsible for activity under your account. Provide accurate information and keep it up to date.
4. Acceptable use
You agree not to:
- use the Service unlawfully or for fraud, spam, or harassment;
- infringe intellectual-property rights or share paid content publicly;
- attempt to probe, scan, or interfere with the security of the Service;
- scrape, reverse-engineer, resell, or redistribute the Service or its content;
- share your account login so that others can access paid content without paying.
5. Licence
On purchase, you receive a limited, non-exclusive, non-transferable licence to access the Service for personal, non-commercial use. We retain all intellectual-property rights in the Service, including written material, recordings, illustrations, and branding.
6. Your content
Journal entries and other content you enter belong to you. You grant us a limited licence to store and process that content solely to provide the Service to you.
7. Payment, billing, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, taxes, invoicing, and billing mechanics are governed by Paddle's Buyer Terms. For our refund terms, see the Refund Policy.
8. Service level and warranties
The Service is provided on an "as is" and "as available" basis. We do not guarantee it will be uninterrupted, error-free, or available at all times. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Suspension and termination
We may suspend or terminate access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. Where a refund is issued, access to paid content will be revoked.
10. Liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is capped at the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages (including loss of profits, data, or goodwill). Nothing in these Terms limits liability for fraud, death, or personal injury where such limits are not permitted by law.
11. Indemnity
You will indemnify us against third-party claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
12. Changes to the Service or these Terms
We may update the Service and these Terms from time to time. Material changes will be reflected here with a new "Last updated" date. Continued use after changes means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the seller's jurisdiction. Disputes will be brought in the competent courts of that jurisdiction, unless applicable consumer law gives you the right to bring a claim elsewhere.
